This Privacy Policy & Cookie Notice applies to information collected and processed via www.modeshworld.com and its associated mobile applications (collectively the "Platform") and associated Platform customer service channels. We take your privacy very seriously and therefore want you to know how your data is collected, used, shared and stored. The Platform is owned and operated by DXBeyond LLC, a limited liability company registered in Dubai, UAE with commercial license number 1245969 and its registered office at P.O. Box 45060, Dubai, UAE ("we", "us", "our" or the "Company").

By accessing or using the Platform or otherwise providing us with your Personal Data, you acknowledge that your information will be collected, used, disclosed and otherwise processed in accordance with this Privacy Policy & Cookie Notice. Where Applicable Laws require your consent for specific processing activities, we will obtain your consent separately where required.

For the purposes of this Privacy Policy & Cookie Notice, "Personal Data" means any information that identifies you or can reasonably be used to identify you.

INFORMATION WE MAY COLLECT
1. We collect information supplied by you via the Platform, other websites or mobile applications operated by us or any of our customer service channels including without limitation on the phone, via email, through social media or instant messaging platforms such as WhatsApp (where available). We also collect information from third parties authorized to share your information with us. We may collect some of this information even if you are not a registered user or do not place an Order. This information may include:
  1. Contact and personal details such as: name, delivery address, phone number, email address, billing and payment information, date of birth, gender, nationality and shopping preferences.
  2. Platform statistical information such as: your location, the URL you use to access the Platform, browser or device type/unique fingerprint, your device’s IP address and domain type, which pages you visited, search terms you entered, items you clicked on.
  3. Transactional information such as: Orders you placed, items you purchased, date and time of Order as well as Orders you decided not to complete or items you placed in your shopping cart and discarded, preferences you have indicated to us.
  4. Information from third parties such as: couriers or payment providers.
  5. Information you supply to us via online or offline surveys, competitions or offline registration through our partners from time to time.
2. Please note that your full payment card details are captured only for the purposes of processing your transaction and are not stored, sold or rented by us. Your full payment card details are not available to our staff. All card transactions are managed by trusted, certified and legally authorized partners who are responsible for ensuring that your payment details remain secure during the payment process.
3. Where you provide the information of a third party to us, you are confirming that you have their consent to do so.

Our Platform uses first party cookies and other similar technologies which we can access when you visit our Platform in the future. We may also use third party cookies.

There are five types of cookies:

Functionality Cookies	These cookies enable you to browse the Platform and use our features such as shopping baskets.

  6. For analytical or statistical purposes

For marketing purposes including communicating promotional information about us, our partners and our websites, emails, SMS, WhatsApp messages, push notifications, newsletters and personalised advertising (subject to your communication preferences). DATA RETENTION

2. Where your Personal Data is no longer required, we will securely delete, anonymise or otherwise dispose of it in accordance with our internal policies and Applicable Laws.

1. Subject to Applicable Laws, you may have the right to:
  1. request access to the Personal Data we hold about you;
  2. request the correction of any inaccurate or incomplete Personal Data;
  3. request the deletion of your Personal Data where there is no lawful reason for us to continue processing it;
  4. withdraw your consent where our processing of your Personal Data is based on your consent, without affecting the lawfulness of any processing carried out before such withdrawal;

  6. exercise any other rights available to you under Applicable Laws.

WHO MAY WE SHARE INFORMATION WITH

  3. Service providers who perform services on our behalf, such as: payment processing, information technology, Platform maintenance, surveys and market research, warehousing and logistics, couriers, advertising and marketing or any service required to process your Order.
  4. Our professional services providers such as: legal, audit, financial and insurance advisers.
  5. Any assignee, successor operator or prospective purchaser of the Platform or of us.
  6. Any legal, regulatory, law enforcement, government or municipal bodies.
INTERNATIONAL TRANSFERS
1. Your Personal Data may be processed, transferred to or stored outside the United Arab Emirates by us, our group companies or our trusted third-party service providers where necessary to provide the Platform, fulfil Orders or otherwise carry out the purposes described in this Privacy Policy & Cookie Notice.
2. Where your Personal Data is transferred internationally, we will take reasonable steps to ensure that it continues to receive an appropriate level of protection in accordance with Applicable Laws.

1. We maintain appropriate technical and organisational measures designed to protect your Personal Data against unauthorised access, disclosure, alteration, misuse, loss or destruction.
2. While we take reasonable steps to safeguard your Personal Data, no method of transmission over the internet or electronic storage is completely secure. Accordingly, we cannot guarantee the absolute security of your Personal Data.
